Moka Smart City achieves a first in Mauritius with the launch of its Property Management Association Regulations

How do we get people to coexist in harmony within the same territory while pursuing the goal of sustainable and integrated development? Through the drafting and implementation of relevant regulations! After more than two years of hard work with French and Mauritian notaries and lawyers, Moka’s teams have formally launched the smart city’s property management associations on 16 May 2022 with the signing of the specifications and bylaws governing the city’s management. This is a giant step forward for Moka – and Mauritius –, ensuring the goals of equity and sustainability for the city’s residents.

These new regulations based on an amendment to the Civil Code of Mauritius in 2018 are aimed at meeting the daily requirements of the city’s residents and users through the introduction of property management associations whose mandate includes various issues like security, waste management, urban development, green spaces, road maintenance, social and cultural life. Property management associations, like municipalities, are essential for the proper management of a city’s common spaces and facilities as well as utilities.

The 3 types of property management associations in Moka

Moka Smart City has three levels of associations.

  • The parent property management association (Association Foncière Mère – AFM), “Moka, the Heart of the Island”, operates at city level.
  • The precinct property management association (Association Foncière de Quartier – AFQ), at precinct level.
  • The block property management association (Association Foncière de Bloc – AFB), at block level.

Together, they will enable residents to play an active part in their daily lives and support the integration of precincts and blocks. Every owner in Moka Smart City will automatically become a member of the three types of property management associations and will be represented, through their vote in their AFB, at their AFQ and AFM level.

Regulations for harmonious coexistence

The regulations of Moka’s property management associations are based on the legal model of urban associations that exist in France, with improvements to fit the city’s scale.

“The  establishment of various levels of association stems from the importance of maintaining territorial unity at city level, the need to stay ahead of the requirements of each precinct and the need for flexibility in the development of the territory. We therefore have, on the one hand, a common set of regulations through the AFM and, on the other, specific rules for precincts and blocks to be set up as new developments take place,” says the General Manager of Moka Smart City Management Ltd, Regis Maubernard.

A Board of Members must therefore be created for the city, but also in each precinct and block. This will enable owners to take part and get involved in decisions made by the city. In addition, this framework makes it possible to define their quarterly contribution according to an equitable and fairer system.

Completion of this milestone demonstrates Moka’s involvement in the management of the city and naturally consolidates its position as the most advanced smart city on the island.
